4.1 Your Responsibility: You are solely responsible for all content, images, data, and materials you upload, submit, or provide to the Service ("User Content"). You represent and warrant that:

• You own or have obtained all necessary rights, licenses, consents, and permissions to use and upload the User Content
• Your User Content does not infringe, violate, or misappropriate any third party's copyright, trademark, trade secret, right of publicity, or other intellectual property or proprietary rights
• You have obtained all necessary permissions from your organization or employer to upload any content related to your work or business
• You comply with all applicable laws and regulations, including the Copyright, Designs and Patents Act 1988 and other UK intellectual property laws

4.2 License Grant to Us: By uploading User Content, you grant Konsept Design Limited a limited, non-exclusive, royalty-free, worldwide license to use, store, process, display, and transmit your User Content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account, except where retention is required by law.

4.3 No Liability for Infringement: We are not liable for any copyright infringement, intellectual property violations, or other legal issues arising from your User Content. You agree to indemnify and hold harmless Konsept Design Limited, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from your User Content or your violation of these Terms.

4.4 Copyright Infringement Claims: If you believe content on the Service infringes your copyright, please contact us at legal@konsept.studio with: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; and (e) a statement of accuracy under penalty of perjury. We will respond in accordance with UK copyright law.

5.1 Output Ownership: Subject to these Terms, you retain all rights, title, and interest in the AI-generated outputs created through the Service using your User Content. Konsept Design Limited claims no ownership rights to the outputs you generate.

5.2 Your Use of Outputs: You may use, modify, distribute, and commercialize AI-generated outputs as you see fit, subject to applicable laws, third-party rights, and these Terms. You acknowledge that AI-generated content may not be eligible for copyright protection under UK law.

5.3 No Warranties: AI-generated content is provided "as is" without warranty of any kind, to the extent permitted by UK law. You are solely responsible for:

• Reviewing and verifying all generated content before use
• Ensuring outputs do not infringe third-party intellectual property rights
• Complying with all applicable laws when using AI-generated content
• Determining the fitness and appropriateness of outputs for your intended purpose

5.4 Platform Role: We act solely as a technology platform facilitating AI content generation. We do not review, endorse, or take responsibility for the accuracy, quality, legality, or appropriateness of outputs. We make no representations about the suitability of outputs for any particular purpose.

6.1 Data Protection: We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and our Privacy Policy. For full details on how we collect, use, and protect your data, please see our Privacy Policy.

6.2 Infrastructure and Partners: We partner with industry-leading technology providers, including Cloudflare and Microsoft, to deliver secure, reliable, and scalable services. We implement appropriate technical and organizational measures to protect your data.

6.3 Security Practices: We implement industry-standard security best practices, including:

• Encrypted data transmission (HTTPS/TLS)
• Secure authentication and access controls
• Private storage with restricted access
• Regular security updates and monitoring
• Data backup and recovery procedures

6.4 Third-Party Processing: User Content and generated outputs may be processed by trusted third-party service providers (including AI model providers and cloud infrastructure partners) to provide the Service. By using the Service, you consent to this processing. These third parties act as data processors under our instruction and are bound by data protection obligations.

6.5 AI Training: We do not use your User Content or personal data to train AI models without your explicit consent.

6.6 Your Security Responsibility: You are responsible for maintaining the security of your account credentials and for restricting access to your account. Please notify us immediately at privacy@konsept.studio of any unauthorized access.

6.7 Your Rights: Under UK GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. To exercise these rights, contact privacy@konsept.studio.

You agree not to use the Service to:

• Upload content that infringes or violates any third-party rights
• Generate or distribute content that is illegal, harmful, defamatory, obscene, harassing, or offensive under UK law
• Violate any applicable laws or regulations, including but not limited to the Computer Misuse Act 1990, Communications Act 2003, or Equality Act 2010
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with, disrupt, or compromise the security of the Service or servers
• Attempt to gain unauthorized access to the Service, other user accounts, or computer systems
• Use the Service for any unlawful purpose
• Scrape, data-mine, or use automated systems to access the Service without permission
• Reverse engineer, decompile, or attempt to extract source code from the Service

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure
• Notify us immediately at legal@konsept.studio of any unauthorized use of your account
• Be responsible for all activities under your account

9.1 Pricing: Certain features of the Service may require payment. All fees are displayed in British Pounds (GBP) unless otherwise stated and are inclusive of VAT where applicable.

9.2 Payment: By providing payment information, you authorize us to charge the applicable fees to your payment method. All payments are processed securely through third-party payment processors.

9.3 Refunds: If you are a consumer, you have the right to cancel within 14 days of purchase under the Consumer Contracts Regulations 2013. However, if you begin using the Service during this period, you may lose this right. For business users, refunds are at our discretion. Contact legal@konsept.studio to request a refund.

9.4 Price Changes: We reserve the right to change fees at any time. We will provide reasonable notice of price changes to existing customers.

11.1 Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded or limited under UK law

11.2 Consumer Users: If you are using the Service as a consumer, you have legal rights under the Consumer Rights Act 2015 and these Terms do not affect those statutory rights. Nothing in these Terms removes your right to receive services that are performed with reasonable care and skill.

11.3 Business Users: If you are using the Service for business purposes, to the maximum extent permitted by law, we exclude all implied conditions, warranties, representations, or other terms that may apply. Subject to clauses 11.1 and 11.2, we shall not be liable for:

• Loss of profits, revenue, business, contracts, anticipated savings, or business opportunity
• Loss or corruption of data or information
• Any indirect or consequential loss or damage
• Any damages resulting from User Content or AI-generated outputs
• Any intellectual property infringement claims related to User Content or outputs
• Any unauthorized access to or alteration of your data

11.4 Maximum Liability: Subject to clauses 11.1 and 11.2, our total liability to you for all claims arising from or related to the Service, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total fees paid by you to us in the 12 months prior to the event giving rise to the claim, or £100, whichever is greater.

11.5 Service Nature: You acknowledge that AI-generated content may contain errors, inaccuracies, or inappropriate material. The Service is provided "as is" to the extent permitted by law.

13.1 By You: You may terminate your account at any time by contacting us at legal@konsept.studio. If you are a consumer, you may have cancellation rights under the Consumer Contracts Regulations 2013.

13.2 By Us: We may terminate or suspend your account and access to the Service immediately if: (a) you breach these Terms; (b) your conduct is harmful to other users, us, or third parties; (c) we are required to do so by law; or (d) we cease providing the Service. We will provide reasonable notice where possible and required by law.

13.3 Effect of Termination: Upon termination, your right to use the Service ceases immediately. We will delete your User Content in accordance with our data retention policies and UK GDPR requirements. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

15.1 Governing Law: These Terms and any disputes or claims arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) are governed by and construed in accordance with the law of England and Wales.

15.2 Jurisdiction - Business Users: If you are a business user, you irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

15.3 Jurisdiction - Consumer Users: If you are a consumer, disputes may be submitted to the jurisdiction of the courts of England and Wales, or if you live in Scotland or Northern Ireland, you can bring proceedings in your local courts.

15.4 Alternative Dispute Resolution: If you are a consumer and have a complaint, please contact us first at legal@konsept.studio. If we cannot resolve your complaint, you may be entitled to use an alternative dispute resolution service. EU consumers can access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Konsept Design Limited regarding the Service.

16.2 Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms without restriction.

16.5 Third-Party Rights: These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.

16.6 Force Majeure: We are not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control.
